If you have life insurance, you likely have determined that if you die there is a financial need that must be addressed by your absence. Because of this determination, you pay a small amount each year in premium to the life insurance company for the guarantee that if you die a larger sum of money will be delivered to the named beneficiary.
All wills filed with the Philadelphia Register of Wills are public records. The Philadelphia Register of Wills has records going back to 1924, and all records in the Philadelphia Register of Wills office are open and available to the public.
As of November 6, 2006, the Pennsylvania Uniform Trust Act imposes a duty on trustees to inform trust current beneficiaries about the existence of a trust and the current beneficiaries’ rights to receive certain information on the trust. These notice requirements for Pennsylvania trustees are dependent on specific triggering events*. A current beneficiary is a person at least 18 years old to or for whom income or principal of a trust must be distributed currently or a person at least 25 years old to or for whom income or principal of a trust may, in the trustee’s discretion, be distributed currently.
A common question we receive from potential clients is, “What happens to my things if I die without a Will?” This is usually followed by the question, “If I die without a Will, doesn’t everything just pass to my wife/husband?” or by the question, “Does the Commonwealth get all my things if I die without a Will?”
