Where Does Burlington County Probate Take Place?

The Burlington County Surrogate oversees Probate in Burlington County. The New Jersey Constitution established the Surrogate Court as the court in each county responsible for certain duties and functions related to wills, guardianships and matters regarding incapacitated persons. The current Burlington County Surrogate is Mary Ann O’Brien.

If you die without a Will, you are “Intestate.” If you have no Estate Plan, then your assets pass under New Jersey’s plan. A Will allows you to craft a plan that reflects your real wishes. How Much Should a New Jersey Probate Attorney Charge?

How Much Can a New Jersey Executor Charge?

Unlike neighboring Pennsylvania, the answer can be simple. The New Jersey legislature has enacted a series of statutes detailing an acceptable Burlington County executor fee for an average estate when the testator has not specified otherwise. How Much Can a New Jersey Trustee Charge as a Fee?

The Trust document often states the Trustee’s fee, which is often “reasonable.” If however, the grantor has failed to specify the compensation, the New Jersey legislature has provided for a statutory fee schedule. What is the Maximum New Jersey Power of Attorney Fee?

How Much Can a New Jersey Guardian Charge For His Services?

New Jersey has adopted the same fee schedule for guardians and trustees. The bifurcated approach that allows a guardian to take a percentage based fee on any income received during the year, and another percentage based on the principal.
